利用規約（エンドユーザーライセンス契約）

本利用規約（以下「本規約」）は、andaugment（以下「開発者」）が提供するソフトウェア「Keep Awake Pro」（以下「本ソフトウェア」）の使用に関する条件を定めるものです。本ソフトウェアをインストール・使用することで、本規約に同意したものとみなします。
第1条（ライセンスの付与）
開発者は、本規約に従う条件のもと、購入者に対して以下のライセンスを付与します。
- 個人利用：制限なし（商用環境での個人使用を含む）
- 同時使用台数：購入者本人が使用する複数のPCへのインストールを許可します
- 期間：無期限（ただし本規約が継続する間）
第2条（禁止事項）
購入者は以下の行為を行ってはなりません。
- 本ソフトウェアの販売・再配布・サブライセンス
- 本ソフトウェアのリバースエンジニアリング・逆アセンブル・逆コンパイル
- 本ソフトウェアを利用した不正行為、他者への迷惑行為、法律違反行為
- 本ソフトウェアの著作権表示・ライセンス表示の削除または改変
- 職場等の規則に違反する形での使用（本ソフトウェアの使用可否はご自身の責任でご確認ください）
第3条（所有権）
本ソフトウェアに関するすべての知的財産権は開発者に帰属します。本規約により購入者に付与されるのは使用権のみであり、所有権の移転はありません。
第4条（免責事項）
重要：本ソフトウェアは現状有姿（AS IS）で提供されます。
- 本ソフトウェアの使用によって生じた直接的・間接的・偶発的・特別な損害について、開発者は一切の責任を負いません
- 本ソフトウェアの使用によるPC・業務・職場環境への影響について、開発者は責任を負いません
- 本ソフトウェアは「特定のアプリが起動中のみ有効」等の機能を提供しますが、その動作の完全性・正確性を保証しません
- Windowsのアップデートにより一部機能が動作しなくなる場合があります
- 本ソフトウェアを職場やリモートワーク環境で使用することによる責任は、すべてユーザー自身が負うものとします
第5条（保証の否認）
開発者は、本ソフトウェアが特定の目的に適合すること、商業的な品質基準を満たすこと、エラーが発生しないことを保証しません。
第6条（返金・キャンセル）
デジタルコンテンツの性質上、購入後の返金は原則として承っておりません。ただし、本ソフトウェアが正常に動作しない場合は、お問い合わせください。
第7条（アップデート）
開発者は本ソフトウェアのアップデートを提供することがありますが、その義務を負うものではありません。アップデートが提供された場合、購入者は無償で利用できます。
第8条（規約の変更）
本規約は予告なく変更される場合があります。変更後の規約は本ページに掲載し、変更後に本ソフトウェアを使用した場合、変更後の規約に同意したものとみなします。
第9条（準拠法・管轄）
本規約は日本法に準拠します。本規約に関する紛争については、開発者の所在地を管轄する裁判所を第一審の専属的合意管轄とします。

Terms of Service (End User License Agreement)

These Terms of Service ("Terms") govern your use of Keep Awake Pro ("the Software") developed by andaugment ("the Developer"). By installing or using the Software, you agree to these Terms.
1. License Grant
Subject to these Terms, the Developer grants you a license to:
- Use the Software for personal purposes (including commercial personal use)
- Install the Software on multiple PCs used by you personally
- Use the Software indefinitely while these Terms remain in effect
2. Restrictions
You may NOT:
- Sell, redistribute, or sublicense the Software
- Reverse engineer, decompile, or disassemble the Software
- Use the Software for illegal activities or to harm others
- Remove or modify any copyright or license notices
- Use the Software in violation of your employer's or organization's policies (you are solely responsible for ensuring compliance)
3. Ownership
All intellectual property rights in the Software remain with the Developer. These Terms grant you a license to use the Software, not ownership.
4. Disclaimer of Liability
Important: The Software is provided "AS IS" without warranty of any kind.
- The Developer is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Software
- The Developer is not responsible for any impact on your PC, work, or workplace environment
- The Software's functionality (trigger, schedule, battery features) is not guaranteed to be error-free
- Windows updates may affect Software functionality
- Use of the Software in workplace or remote work contexts is entirely at your own risk
5. Disclaimer of Warranty
The Developer makes no warranties that the Software is fit for any particular purpose, meets commercial quality standards, or is error-free.
6. Refunds
Due to the digital nature of the Software, refunds are generally not available after purchase. If the Software fails to function, please contact us.
7. Updates
The Developer may provide updates at their discretion but is not obligated to do so. Any updates provided are available to purchasers at no additional cost.
8. Changes to Terms
These Terms may be updated without notice. Continued use of the Software after changes constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the Developer's place of residence.
